FIFTH CIRCUIT DENIES QUALIFIED IMMUNITY FOR OFFICER IN NO KNOCK EXECUTION OF SEARCH WARRANT.

This needs to happen more in questionable raids, particularly ones that turn deadly. Then this problem might lessen significantly.

  1. John Smith. Says:

Looks like they based it on poor warrant procedures rather than no knocking…

  2. Alan Says:

It’s about time someone noticed that word “qualified” before immunity.

  3. Weer'd Beard Says:

Again unless we’re talking about active attacks, or hostage situations there should NEVER be no-knock warrants.

If they can destroy the evidence in the time it takes to serve a warrant then there really isn’t enough of a crime to commit to sent in the goon squad.

  4. nk Says:

They violated their civil rights while armed with handguns. (cf. Ramos and Compean) Mandatory twelve years. Won’t happen. Prosecutorial discretion.

  5. MAJ Mike Says:

I live in San Antonio and this is the first I’ve heard of that incident. The Establishment has kept real quiet about this.

  6. Bubblehead Les Says:

So will San Antonio be Dumb and push it up to the Supreme Court or will they be Smart and just cut a Big Check?

    I’m voting for Dumb.

Remember, I do this to entertain me, not you.
