Embody to the supreme court
Monday, February 3rd, 2014Well, he’s trying.
Well, he’s trying.
This time, he open carried an AR-15 with a silencer and was arrested for not showing the po-po his tax stamp.
Trying to go all the way to the supreme court. David Hardy doesn’t think much of the case.
You can see the opinion here. And this quote: For his troubles, Embody has done something rare: He has taken a position on the Second and Fourth Amendment that unites the Brady Center to Prevent Gun Violence and the Second Amendment Foundation. Both organizations think that the park ranger permissibly disarmed and detained Leonard Embody […]
Generally speaking, in common law it was an offense to go about armed to the terror of the people.
Threats to gun rights: bad lawsuit edition You’ll recall that Leonard decided to grab an AK pistol with the barrel painted orange so that it resembled a toy and go on a traipse through a park. Not a good move from a PR perspective and not one designed to win hearts and minds. He sued […]
David Randolph Smith, no doubt gloating, emails that Embody’s case against the state has been dismissed. Not a surprise.
Here. Judge says that sheriff can fill out the form like he chooses (in this case stating the sheriff gave more info) and that is considered executed. The determination for approval, says the judge, lies with ATF.
He lost his case. Seems that marking up the NFA forms is considered executing them. And he asks Haslam about gun permits.
Embody update
Leonard Embody has lost in court. Again. And set up bad case law. Again: The Tennessee Appeals Court has ruled against a man who claimed state law regulating the carrying of firearms was unconstitutional. Leonard Embody filed suit in 2010 after state officials took away his carry permit, finding a “material likelihood of risk of […]
Leonard Embody keeps trying. And failing. Dude, seriously, leave it to the experts
From the not helpful files, Leonard Embody comments: I recently bought a bullet proof vest to protect me from idiots who would shoot law abiding citizens. Well, I tend to avoid being placed in such situations by, say, not walking through parks with AK-47s. YMMV.
A few folks who’ve been quite successful tell me that the biggest threat to gun rights are bad lawsuits. They continue to be right: Leonard Embody Gets Court to Declare Public Parks (!!!!) are “Sensitive Places” under Heller. I know Leonard is trying to do what he thinks is right. But let’s leave that to […]
An update on Leonard Embody’s case.
The Tennessean has an interesting bit on Leonard Embody, who has a habit of challenging Tennessee gun laws in interesting ways.
A memorandum here. Looks like Embody’s challenge to the carry laws is getting some attention. The AG says the challenge based on constitutionality isn’t gonna fly.
Leonard Embody has dropped his appeal so that his lawsuit can go forward.
In Tennessee, there is a law that states the local chief law enforcement must, within 15 days, sign off on paperwork for NFA weapons. There was a case in 2007 where a sheriff refused to sign this paperwork. This is happening again. Everyone’s favorite local gun guy Leonard Embody (who took a jaunt through a […]
Remember the idiot who painted his AK pistol’s barrel orange so it looked like an airsoft gun then went wandering through the local park carrying it openly? Cops were called and no charges filed because he didn’t break the law. Being stupid isn’t a crime. But he lost his handgun carry permit because he was […]
I got this via email of the NRA warning that: On Wednesday, March 17, the Belle Meade Board of Commissioners will consider a proposed ordinance (Ordinance 2010-2) that would forbid any person with a handgun carry permit to carry within the city limits. This would be problematic because it’s a violation of Tennessee’s preemption laws. […]
You’ll recall some guy strapped on an AK pistol with the tip painted orange (so it would look like an airsoft toy) and went walking around a park. The police detained him trying to determine if his weapon was legal or not. And, since it was a pistol, it was. Anyway, the guy is now […]
Over at Science Daily, comes the PSH: In “Guys and Guns Amok: Domestic Terrorism and School Shootings from the Oklahoma City Bombing to the Virginia Tech Massacre” (Paradigm, 2008), UCLA professor of education and cultural critic Douglas Kellner argues that school shootings and other acts of mass violence embody a crisis of out-of-control gun culture […]
Feewings. Nothing more than feewings: I am absolutely sick and tired of the very phrase “Self Esteem”; embodying as it does the concept that one should have warm fuzzy feelings about one’s self for no adequately explained reason whatsoever, as though by simply existing, one was doing something inherently good rather than merely converting oxygen […]
Remember, I do this to entertain me, not you.
