    Hope they win this one. It would help those who live in Maryland or are Stuck in Massachusetts (with their Blogger Sites being Down) cross the State Line and engage in InterState Commerce, which no State has the right to restrict.

    This is a very audacious suit. It is a head-on challenge of the GCA of 1968 on 2nd A. grounds.

    My only fear is that if Charles Sykes gets a new lease the court will consider Ms. Lane’s complaint moot.

    Considering that there’s another FFL in DC who has been trying to find a lease since 2008 without success, I doubt it will be an issue.

    There’s another suit in play challenging residency restrictions so if DC folds the cause isn’t really dead.

    For Sykes to get a lease quickly enough to matter DC will likely have to either grant just him an exemption, which opens up equal protection issues, or change their zoning regs and make it easier for any FFL to set up shop, which, given the untapped market, several probably will, heck some might even if primarily on principle.

    Since one of the keystones of their remaining restrictions is making it so damn inconvenient to actually buy a gun in the District, by loosening restrictions on FFLs this is a blow either way.
