Sense and not making any

So, if I understand this correctly, here’s the reasoning: Police want to raid alleged drug dealer. Police get no knock warrant. Police conduct raid late at night so that they can catch them off guard. The plan worked and they were off guard. So, being off guard, person at the house opens fire. Now, the police say that she should have known they were police.

It makes no sense to me.

    Anyone have any stats on the % of Police shot during no-knock warrants vs. traditional?

    Could make for interesting reading. Anyone want to take bets on whether no knock warrants are more dangerous for both sides?

    The police unilaterally escalate the situation with a no-knock warrant. They are introducing more risk for the sake of a stronger investigation.

    I think they should be the ones assuming that risk, physically and legally, not the general public.

    It is impossible to know it is the police. There isn’t enough time, the person has just been woken up, the noise and confusion trigger a flight or fight response. No knock warrants are poor police procedure and of course unconstitutional. In addition, the cops often have difficulty finding the correct house.

    In a no-knock warrant home invasion search the police should be forced to accept the risk of injury or death as the cost of doing business in that manner. Even if they have the right address, the right suspect and even if they are guilty of a crime, any police officer shot, injured or killed should not be cause for charges or lawsuits against the residence of the home.

    I guarantee you, if any state legislature were to make that proposition law we would actually see an improvement in safely conducted arrests and searches. We would also see of lot of steroid gunslingers opting off the SWAT teams.

    WTF do the cops expect the resident to do when they bash down the door and come running in, ask “are you cops?”, before doing anything?

    I’m more and more losing respect for cops in general and judges who allow this crap in particular.

    If they were to be successful at my house, though I have done nothing to warrant (play on words) such treatment, they couldn’t leave me alive because I would hunt them. At that point it wouldn’t be over until I said it was over.

    I do not trespass the homes or families of others and I will not tolerate it done to me or mine.
