Briley and TN Gun Laws

TN State Rep. Rob Briley was arrested for DUI after rear-ending a car and leaving the scene. During his arrest, he allegedly finished his drink at gunpoint. On Monday, he was arrested again for vandalism for kicking the window of a patrol car and causing $1,500 worth of damage. Under the influence, Mr. Briley reacted violently. And stupidly.

As a chairman of the Judiciary committee, Briley blocked various pro-gun bills, including opposing a bill to allow concealed carry permit holders to carry their weapons where alcohol is served so long as they weren’t drinking. No wonder he can’t trust you to be armed in the same room where there may be alcohol, look what it does to him.

Briley is also the guy who put the poison pill in the park carry bill.

Looks like Briley may be facing felony charges over this ordeal. If that happens, he could lose his spot on the committee, if not his seat. Wouldn’t break my heart.

Of course, it’s all that evil alcohol’s fault so he must get to rehab and purge those demons from his system. Again.

Update: The Rep points out that Briley refused a breathalyzer and blood test. I think you lose your license in TN for that.

    You mean to say that a DUI conviction alone WOULDN’T get him thrown off the Judiciary committee? Or out of office altogether?

    Speaking as a police officer in tennessee…yes you do loose your license for one year if you refuse a blood or breath test. Its called the “Implied Consent Law”. TCA 55-10-406.

    Speaking as a prosecutor in Tennessee, one “loses” his license if one refuses the test- but, as with a DUI “loss” of license, the coutr issues a restricted license.

    And no criminal conviction, felony or misdemeanor, will take him out of the legislature. A felony conviction will only remove him from his committee chair.

    Not defending Briley, but that not being able to consult an attorney before deciding to consent to a breathalyser is a clear violation of your rights.

    Unless, of course, that you consider driving a privilege and not a right (a right subject to being restricted on a case by case basis after that pesky thing called due process)
