Gee, wonder why?

Obvious:

The public’s image of the Supreme Court has eroded over the past few years, with just over half of those in a new poll saying they have a favorable view of the high court.

Well, let’s see. In the recent past, the SCOTUS has:

Killed the federalism and states’ rights (states’ rights is a racist codeword by the way, and that makes me a racist), while kissing the commerce clause good-bye.

Continued killing the fourth amendment. Just repeal it already.

Ignored guns by refusing to hear a variety of cases. Yet, finds the time to tell the ninth that it needs to take a pro-gun ruling back.

Its refusal to address those being detained who were not charged with crimes.

Killing the first amendment in the name of campaign finance reform.

The Supreme Court, often thought to be the last hope, merely shills for the powers that be.

Update: Yeah, killed the commerce clause was not appropriate. Corrected.

They haven’t killed the Commerce Clause. Quite the opposite.

  2. SayUncle Says:

Oops. Poor wording. Abused the commerce clause is more appropriate or killed the underlying reason for the clause.

Yeah, you’re right, I’m sorry. I imagined the entire chapter of our nation’s history where states’ rights and the confederate flag were actively used as anti-civil-rights rallying points.

Your refusal to acknowledge the racist elements of these things doesn’t make you a racist. It makes you naive.

  4. Xrlq Says:

Oh, please. There is no “racial element” to states’s rights, any more than there is a “racial element” to voting, judicial review, or that all-hallowed filibuster. All four are race-neutral (and in most instances, completely unrelated to race) tools that both can be and have been used toward racist ends on some occasions, and toward benevolent, non-racist (or even anti-racist) ends on others.

To argue otherwise is to say “if sick Californians can smoke pot, the Klan wins.”

Speaking of California, I did feel this earthquake.

  5. tgirsch Says:

And I’m sure the confederate flag is completely free of racial connotations, too. Ignore history all you like, that doesn’t mean it wasn’t there…

  6. tgirsch Says:

And of course they’re race-neutral on their face: that’s the point. If they were unambiguously racist, they would lose their value as code words. I wish we lived in a world where politicians didn’t coyly try to appeal to shady constituencies, but that’s simply not the world we live in.

Remember, I do this to entertain me, not you.
