Does the private citizen who performs the NICS check have to maintain the records for umpteen years like an FFL, send them to BATFE upon my death or bankruptcy, and grant BATFE access to review those records at any time, like an FFL?
Because if so, might as well be an FFL.

uh, don’t say never. There’s some Fudds and New Guys who will try it.
The Problem lies with the BATFEIEIO telling the FFL Holder he HAS to do it. Not sure that’s Legal.

@mikee, When the private citizen “performs the NICS check” he must get a FFL to handle it. The FFL must require the buyer to fill out a 4473 and then the FFL retains it for 20 years like any other 4473.

So it is essentially like a poll tax, a tax on exercise of an enumerated right?

If it were required each time before you voted, yes. Or maybe paying for a permit each time you wanted to vote.
But since voting isn’t a specific enumerate right perhaps a better analogy would be be requiring you to pay for a background check when you joined a church or bought a Bible/Koran/Torah/etc.
