    The story here is the outrage by the neighborhood. That’s the interesting note for sayuncle regulars. If the homeowner really was a felon which prohibits gun ownership, he broke the law and should be charged.

    Wonder how he passed the background check for his FOID and I’m sure He registered it with Chicago PD as required by local law……

    But that’s the “Chicagoian” attitude. “Those laws are for the other guys, not me or my family at home.”

    Any legislator tells you that registration in your city is for the protection of their officers is full of bull pucky. Any cop that walks into a home on a angry domestic call (after checking a registry database) and thinks if their not on a gun list, “its safe to believe there’s not a gun in the house , because none are registered to this address.” is a fool with his life and that of his partners. Any old and wise street cop in Chicago will tell you to always treat residents as if they might be armed.

    If he has a FOID, he’s home free. Under state law, he 1) is at liberty to keep a gun in his home and 2) since he used it in self-defense, state law preempts any local ordinance.

    Even without a FOID, the most he can be charged with is not having a FOID, a misdemeanor. Generally, the State’s Attorney exercises discretion not to punish the victim and declines to file.

    I thought the Supreme Court has ruled that even felons have a right of self defense.

    If the gun is almost as old as he is, it may have been in his sock drawer since before Chicago started FOIDs and bans and other foolishness.

    As I recall, guns in sock drawers have a low propensity to leap up and commit mayhem by themselves. There are at least two on the web, monitored on webcams without incident, one since before Heller was decided and another that started just last year. I would guess there are many more latently murderous guns hiding in sock drawers of both felons and non-felons all across this country.
