It seems that, though a tomato is technically a berry, that the supreme court has ruled in Nix v. Hedden that a tomato is a vegetable. Forget science, let judges decide. Via comments here.

Now this is just weird. I read that Wiki entry yesterday.
I also learned that it’s only for tax purposes. God help us if they figure out they can do “only for tax purposes” on whatever they want. Or maybe they already have.
