Guns and social security

The Obama administration is looking to report those who are unable to manage their own affairs due to “marked subnormal intelligence, or mental illness, incompetency, condition, or disease” to the National Instant Check System, which would deny them the ability to buy guns.

    So Obama wants to deny the elderly and informed their right to armed self defense. He’s an evil, wicked man!

    Apparently, federal law leaves it to the states to determine a process for declaring a person mentally incompetent for the purposes of voting. Washington state law:

    All persons while they are judicially declared mentally incompetent are excluded from the elective franchise.
    WA. CONST. art. 6, § 3.

    Upon receiving official notice that a
    court has imposed a guardianship for
    an incapacitated person and has
    determined that the person is
    incompetent for the purpose of
    rationally exercising the right to vote,
    under chapter 11.88 RCW, if the person
    is a registered voter in the county, the
    county auditor shall cancel the person’s
    voter registration. WASH. REV. CODE
    ANN. § 29A.08.515.

    AHA! It only counts if a court has imposed a guardianship. I suppose that would satisfy that pesky ‘due process of law’ thing. A bureaucratic process doesn’t count.

    But apparently, under current federal interpretation, other enumerated and protected rights do not require a judicial process to be infringed. I suppose there is room for a ‘deprivation of rights under color of law’ suit against the VA for due process reasons, if not Second Amendment reasons.

    @Phelps, but from the perspective of the ruling elite class, when it comes to “keeping guns out of the wrong hands”, it’s all good.
