NFA Trusts

The DOJ is moving forward regarding NFA transfers for trust. At issue, is having the responsible persons get LEO sign off and do a background check.

    Not sure if it still holds but here in Harris County Texas as of the last time I thought about getting a can going the LEO sign off route rather than a trust, Harris County wouldn’t do it, and Harris is the largest county by population pretty much encompassing all of Houston.

    While CLEOs refusing to sign off on transfers is certainly a significant factor in the increased use of legal entities for the ownership of Title II firearms, I believe that communal possession is a bigger factor.

    If I have a Title II firearm registered to me, personally, it imposes a significant burden on me in terms of ensuring others do not have access to it in my absence. This is a HUGE pain in the ass.

    On the other hand, if I have it registered to a legal entity which I control, I have the option of designating other officers/trustees/employees of that legal entity who may also legally possess the firearm in question.

    That means that Title II firearms owned by the legal entity can arrive at the range with one individual and leave with a different individual. This is incredibly convenient.

    Then there’s the cost of fingerprints, photographs, and CLEO signoff, both in terms of time and cash. All things considered, this can easily add up to ~$50+ per person per Form 4.

    Frankly, I don’t see any reason to bother doubling down on a slow and inefficient 80+ year old process when we can accomplish the same thing with a five minute phone call….

    In light of the Brady Background Check Law, there’s really no reason why Title II firearms shouldn’t be over-the-counter items….

    Well a nice thing states can do is pass Shall Sign laws. That makes it real easy to bypass the LEO requirement.

    But yeah, this is an antiquated process. Remove suppressors, SBRs, and SBSs from the NFA, and Fine, have a registration requirement for MGs, but not the additional check.

    Am i the only one wondering how the BATFE is justifying regulations using the IRS codes? 26 usc 7805 only grants the secretary of the Treasury Department any regulatory authority.
