Because it costs money?

Earl walked right through that restraining order:

These Abusers Aren’t Allowed To Own Guns. So Why Aren’t States Removing Them?

No way that could be abused, right? You do realize that the burden of proof for obtaining a restraining order is probable cause and that they can be issued without notice to the subject? In other words, if a gun-owner’s girlfriend, boyfriend, mother-in-law, sister, brother, adult child, ex-wife or ex-husband gets angry enough to make up a story and tell it to a magistrate, a restraining order will be issued on their word alone. Restraining order issued, cops steal guns, cops “lose” or damage guns, cops refuse to return guns without owner having to hire a lawyer (maybe costing more than the guns involved); what could possibly be wrong with any of that?

So if this silliness becomes law, all a person needs to do to divest someone of their property and their constitutional rights is to tell a lie to a court official. They don’t even have to be particularly convincing because the subject of the RO won’t have the opportunity to offer evidence or cross-examine.

The restraining order system and “shall arrest” domestic violence policies have made enough of a mess, we don’t need to make it worse by adding additional perverse incentives to greedy policemen, vengeful relatives or formerly significant others.

Of course the accused must be granted due process before taking his rights away…

    But…
    1. It’s HuffPo
    2. The very “campaign” mud slinging espoused by a certain “Woman”s issues” candidate in Maine.

    last minute, pre election, oratory.

Because they are only interesting in disarming the law-abiding?

Remember, I do this to entertain me, not you.
