Not Helping

Leonard Embody has lost in court. Again. And set up bad case law. Again:

The Tennessee Appeals Court has ruled against a man who claimed state law regulating the carrying of firearms was unconstitutional.

Leonard Embody filed suit in 2010 after state officials took away his carry permit, finding a “material likelihood of risk of harm to the public.”

The revocation came after Embody was detained by Belle Meade police in 2010 while walking with a .44 caliber black powder revolver in his hand. He was detained in 2009 while walking in Radnor Lake State Park with an AK-47-style pistol. There have been at least three similar incidents, although Embody was never charged with a crime.

    Heard this while we were in Nashville over the weekend. First thing I thought of was, “I have an article on this that still is not finished after over a month.”

    Yea, his antics are stupid, but they are legal too.

    Reminds me of 1970s civil rights agitators, not the ones you hear about today either, who did very basic, simple things. Like walking through “exclusive” neighborhoods, on the public right-of-way, without ID. They got arrested, went through the court system, and won. I do not know this to be a fact, but it always seemed like they had some of the judges lined up in advance for their “test cases” to get high enough to be noticed. Looks like this fellow skipped that step, and our courts stuck with their statist DNA.

    Wish I had enough basic data to look them up. I remember several were on Donahue a few times, which is not evidence of course, just more data to help find evidence.

    It’s the one thing about our Constitutional Rights that I wish more would consider… Just because you can doesn’t always mean you should. There is a difference between making a point because you must and making a point just because you feel like it. I have always thought this guy is not so much a supporter of our rights as he is using it to seek a law suit.

    The best thing that could happen to the cause of freedom would be this guy keeping his mouth and his legs closed. Thus, he will not cause anymore unnecessary ruling and case law that work against us, and it will prevent further generations from his loins from doing the same.

    He is not a shill, as he is in fact an FFL holder. The reason he was carrying the black powder revolver is because the town law specifically states that the only legal carry is this model(or one other) held in your hand.
    Granted, he could be a little more circumspect, but being in your face worked for the gays so why not us?
