Legislation to protect gun rights?

    Nationwide pre-emption law? That would be cool.

    Of course, there was a type of nationwide pre-emption law in FOPA…

    Geez, Wayne, we’ve had legislation to protective gun rights since the North won the Civil War, you tool.

    Wayne, go run down the hall to Rich’s office and have him give you a copy of 18 USC §241, inter alia.

    Let’s start the prosecutions. RICO the Brady Bunch and put them under the BoP!

    We need a clear national preemption law…with MINIMUM sentences. Say 2-5 years for the first offense, 5-15 for he second, life without possiblity of parole for the third. And any jurisdiction becomes ineligible for Federal funds of ANY sort, including disaster relief. THAT will put local governments on notice.

    But a Firearm Owner’s Rights Act needs to go beyond that. It needs to extend to commerce, like the Civil Rights Act of 1964. Take a look at the currently-legal discrimination against firearm owners. You can use Paypal to buy everything…EXCEPT anything firearm-related. You can ship anything not inherently hazardous by mail…EXCEPT for firearms. And I’m sure that other people can come up with a long laundry list of other examples.

    Personally, I’m for taking the Civil Rights Act of 1964 and adding “firearm owner” to the list of groups that cannot be discriminated against.

    No legislation is needed, unless we’re talking about creating a better system to enforce the Bill of Rights against all aggressors.

    We already have it, I just cited 18 USC §241. Civilly we can sue them under 42 USC §1983.

    I don’t think the antis understand what the court just did in McDonald (and I have not seen many blogs who realize what happened): the Supreme Court just unleashed the DoJ and civil attorneys to go after their allies in the big cities and the Brady Bunch themselves.

    In 2013 we need to start demanding criminal prosecutions for those who espouse gun control!
