Kwan Case: Charges dismissed

Friday, July 3rd, 2009

David reports that charges against Albert Kwan have been dismissed: The government has thrown in the towel in its prosecution of Albert Kwok-Leung Kwan for possession of a short barreled rifle. A June 25 order dismisses the indictment against him “based on the government’s motion.” You can see past coverage here. Short version is he […]

the wrath of Kwan

Tuesday, November 11th, 2008

David reports a victory for Kwan: We therefore conclude that the district court did not abuse its discretion in ordering a new trial to instruct the jury that the Government had to prove that Kwan had no other apparent legal purpose for the shoulder stock than to convert his unregistered pistol into an illegal short-barreled […]

Kwan Case Updated

Monday, August 20th, 2007

Looks like a new trial in the Kwan case. David Hardy has the ruling and some analysis: One gets the impression the court was a bit put off by ATF. (1) The raid was without any basis. Defendant had been an NFA dealer, and when he went out of that business, transferred an NFA gun […]

ATF & Shoulder Stocks

Friday, August 29th, 2008

Th Wrath Of Kwan! David Hardy: District Court ruling, in pdf, here. Defendant, a reservist, has two handguns (one a semiauto, one a registered full auto) and two shoulder stocks that would fit either. The shoulder stocks double as holsters, and he has one handgun in each when ATF raids him (on other grounds, which […]

More stellar performance from ATF

Thursday, August 9th, 2007

On the Kwan case (background here): Friday the Judge in US v. Kwan set aside the verdict on the Short Barreled Rifle. There will be a hearing in three weeks to determine if US attorney wants to retry or make motion to dismiss. Seems the ATF mis-represented some facts David notes: The Judge set aside […]

ATF Targets Gun Dealer

Monday, July 30th, 2007

Here’s more info on the Kwan case: The ATF did two things here during this case: 1.) ATF examined every gun in his inventory [by flying out a firearms technology branch expert]. Many were forwarded to FTB for further “testing”. The ATF took a semi version of the M-14 and the ATF, not Mr. Kwan […]

ATF and the law

Tuesday, July 3rd, 2007

The ATF has a history of disregarding the law when it suits them. And here are a couple of cases to illustrate that. The first is the ATF’s position that a pistol with a forward grip is an Any Other Weapon. As a result of their contention is that such a configuration requires said weapon […]

The Airing of Grievances: Grievances Past

Monday, December 18th, 2006

Last year’s grievances: It’s the end of the year, holiday time. A time for reflection. A time for a look back. A time to be thankful that the baby Jesus was born, died and resurrected as a fat guy, who delivers presents, chants Kujichagulia through a menorah during his month long fasting because he’s trying […]

Q: When is a gun a machine gun?

Monday, October 23rd, 2006

Komo News: Kwan legally owns more than 100 pristine and historical machine guns. But during a search of Kwan’s home in January 2005, agents found one – an M-14 – that they said was illegal. Kwan’s attorneys argue that the M-14 in question required substantial modification by federal agents – including use of a rotary […]

Holiday Cheer

Friday, December 23rd, 2005

It’s the end of the year, holiday time. A time for reflection. A time for a look back. A time to be thankful that the baby Jesus was born, died and resurrected as a fat guy, who delivers presents, chants Kujichagulia through a menorah during his month long fasting because he’s trying to lose all […]

This War on Christmas Nonsense

Friday, December 9th, 2005

Apparently, some political talking heads (most notably Bill O’Reilly) are yammering on and on about how Christians, being the minorities we are, are being oppressed because of the treatment of Christmas. And they’re hopping mad that people say things like Happy Holidays instead of Merry Christmas. They’re also apparently upset that some retail outlets, who […]

It’s officially Christmas

Wednesday, December 10th, 2003

I know this because the local radio station is playing Shirley Liquor’s Twelve Days of Kwanza. A couple years back, this radio station (who coincidentally has the ugliest website on the planet) came under fire for playing it. They did the right thing and still play it. Sure, it’s offensive to someone but it’s funny.

Remember, I do this to entertain me, not you.
