Silencers in the courts

SCOTUS has turned down a silencer case:

The Supreme Court rejected a challenge to federal regulation of gun silencers Monday, just days after a gunman used one in a shooting rampage that killed 12 people in Virginia.

The justices did not comment in turning away appeals from two Kansas men who were convicted of violating federal law regulating silencers. The men argued that the constitutional right “to keep and bear arms” includes silencers.

*snip*

In the silencer cases, Kansas and seven other states joined in a court filing urging justices to hear the appeals. The states said the court should affirm that the Second Amendment protects “silencers and other firearms accessories.” The other states are: Arkansas, Idaho, Louisiana, Montana, South Carolina, Texas and Utah.

But I was assured he was pro gun:

President Donald Trump’s administration asked the court to stay out of the case and leave the convictions in place.

Correct call. Not the right case to take to scotus…blatant breaking of existing rules, it was a can’t win.

Take another look at the new chief of ATF to see the long game and proof that The Donald is a lot smarter than you.

  2. mikee Says:

This looks like an example of prioritization by members of the Court, and the Executive Branch.

Silencers aren’t that big an issue in gun law right now compared to magazine capacity, right to carry, or semiauto bans, for example. Nor are silencers low hanging fruit, to be plucked without a political price.

And gun rights all together aren’t as important to politicians right now as immigration, trade wars, and re-election. If gun rights ever become the most important political issue in the US, may God help us all.

  3. JTC Says:

@mikee, oh 2A rights definitely already are the most important issue because failure on stemming unfettered immigration (which is the second most important issue) means defense against them and the gov that allowed them is the real-deal final frontier.

But as you and I both said, it is a matter of prioritization, or more exactly timing, to get the right case to go after 2A infringement in its entirety, after the 2020 extension of the administration of Depolorables and our CEO DJT, and at least one more seat is secured on the SCOTUS.

More like SCOTUS doesn’t want to light the “Federal law says you can’t; state law says you can” fuse.

JCT “Take another look at the new chief of ATF to see the long game and proof that The Donald is a lot smarter than you.”

The guy that supported SCJ Sonia Sotomayor and Eric Holder? While President of the FOP he backed expanding NICS? Supported universal background checks and opposed Constitutional Carry? That guy?

Yea, the long game…..sucker you folks into believing Trump is pro Freedom so when he steps on you, you say “Step harder daddy! Let Freedom murmur!”

  6. JTC Says:

S.Rambo, not real clear on the whole long game thing I see, proof that you don’t have to be a Trump to be a lot smarter than lots of folks.

  7. JWMACK Says:

This is a simple case of states rights and Trump knows he will lose that fight. The feds do Not have authority over These United States people, wise up.

  8. LCB Says:

Was Trump or the alternative. We really didn’t have much choice, did we?

  9. Sho Rembo Says:

JTC, so appointing someone who thinks only police and military should have firearms as head of the ATF is somehow a long game to keep our Rights? Interesting. How will that work? Is this part of the “3D chess” deal? I think he’s up to like 27D chess now, isn’t he?

LCB, we had quite a few choices during the Primaries, didn’t we? But people heard Trump say mean things about Democrats and they all fell to their knees worshiping him. Seems most of the Trump supporters act just like the Obama supporters.

  10. LCB Says:

    Sho,
Oh yes, I agree. I didn’t vote for Trump during the primary, but when it came to the Prez election…that’s when we didn’t really have much of a choice.

  11. JTC Says:

    SR,

Show me where he said that.

And go ahead and name your woulda coulda prmary pick.

Remember, I do this to entertain me, not you.
