Terror watchlist

So, the president thinks that people on a secret government list (that has included babies, a senator, and 72 department of Homeland Security employees) should be denied constitutionally enumerated rights. And then wonders what the argument against that would be. Volokh responds.

You can be on the list and still work for DHS?

    Dan, much more so when you consider none of the mass shooters was on the No-Fly list. (I’m sure if any of them were, you’d have heard about “No-Fly No-Buy” a long time ago.

    If these people on the list are too dangerous to fly, and too dangerous to own guns, why are they still in this country?

    Looks like the “72 DHS employees” is not quite accurate – they work for airports and airlines, not DHS, but they were cleared by the TSA.

    Instead, I would emphasize the fact that Federal Air Marshals have been kept off their assigned flights because they were on the list, and that this has been enough of an ongoing problem to the point that they had to create special procedures to deal with it when it happens.

    The “no fly list” based is done by secretive and arbitrary actions of unknown government officials and agents. And those elected officials want to apply it to deny the right to acquire weapons are in flagrant violation of the 5th Amendment. This is a DISQUALIFIER for elected or appointed office. It’s an outrageous descent into tyranny.

    How can I get on this watchlist? I want to be watched, and I want to brag to all my friends about it! I want to say, “See! Those two guys across the street are FBI! They’re watching me, because I’m on a watchlist! That’s how important I am! The United States Federal Government has to watch me 24/7, because that’s just the kind of guy I am!”
    Can I get some sort of official certificate to attest to the fact that I’m on the list? I mean, not just an ordinary one, but one with lots of hand signatures, and official gold stamps, and fancy calligraphy and all that? I’m sure that my friends would be very impressed that I’m on the terrorist watch/no fly list. I never fly anywhere anyway, but it would be really, really cool to be on the government watch list! It would be like I was a James Bond 007 spy or something!

    On the other hand, maybe the federal government is just conning us into thinking that they’re actually doing something, when all they have are their phoney, worthless lists made up by bureaucratic clerks.
    Real terrorists should be hunted down and killed by real killers, not bandied about by clerks. In lieu of that, we Americans are accepting phoney lists from our phoney, Muslim terrorist loving Muslim president, who is a jihadi at heart. His AG, Loretta Lynch, just threatened to prosecute Americans who complain about Muslims, immediately after two Muslims murdered fourteen Americans.
