Utah, Wyoming, South Dakota and Montana joining suit over the Firearms Freedom Act.

    The question is: what will the States do when (and I think they will since they’re asking a Federal court if the Federal govmt may or may not do something) they loose. Will they put a Firearms Freedom amendment in their Constitutions? If that fails, will they secede?

    I hope these guys can hang in there. It is going to be a long battle and the batf will do anything within its power to stop. Not necessarily legally either.

    Unless they can overturn the “substantial effect on interstate commerce” precedent, they won’t win. If you accept that interpretation of the Commerce Clause as true, it logically follows that anything can be regulated by the Feds if even one example of it crosses state lines. Even if the guns never leave the state, that means there are that many guns from out of state that won’t be sold there – which means the guns made and kept in Montana do have a “substantial effect” on interstate commerce.

    The Supreme Court Justices who made that original ruling should have been drawn and quartered immediately after.

    They won’t win. Nobody gets a fair hearing when leaving the outcome to the opponent. Make no mistake the federal courts are the opponent of the states and the citizens.

    They need to put teeth in their laws and then defend themselves when they are assaulted by the feds.
