Weapon or toy: could you tell?

I’m guessing it’s the one mandated by law to have an orange tip painted on it?

only problem is, the law stipulates that the toy must be SOLD with the orange tip on it, there are no laws preventing someone from removing the orange tip (at least in most states)

I have a CO2 pistol, looks like a SIG, bought without any red tip. It immediately got a spray painted red tip. Don’t point things that look like weapons at people, especially police.

Does the name Amadou Diallo ring a bell? He got shot for holding out a wallet towards an undercover police team in NY when they burst from a cab to arrest him on suspicion of … well, being suspicious. He apparently thought they were mugging him and was trying to comply….
