    What is the enforcement mechanism? Is it to be caught “in the act” by the ATF or FBI? Local or State LE cannot be constrainec to enforce federal law–just like with immigration laws? There can be sanctuary cities, counties and States–unless a fed agent is present.

    Any law that is a “Gun Control” law is, prima facie, unconstitutional.

    There are no delegated powers for gun control laws pertaining to the People in the Constitution. And according to the clear wording of the 10th Amendment, without delegated powers the Federal Government may do NOTHING. The Federal Government only has power “for governing such part of them (the Militia) as may be EMPLOYED in its service.” (Article I, Section 8.16)

    Post facto. And secondary.

    The former making illegal what was heretofore not illegal which is problematic, so the latter makes the charge an add-on to whatever else the popo are called in for…in which case even Sheriff Andy will be obligated to enforce.

    Get swat’ed for pot and a search turns up a bumpfire, or Heaven help you if you get popped or even just reported for possible DV and there’s a (GASP!) machine gun in your possession? Adios me hermano…

    @JTC, I was referring to how two people making a private sale of a firearm would be enforced if there was no other reason for LE to be on the scene? Seems it would entail ATF and FBI agents doing sting operations to entrap buyer sand sellers. And it would seem that Constitutionally, the Feds only have delegated power re: interstate commerce.

    Ah. Assumed you were addressing Unc’s post title issue.

    Still, the answer is the same. No primary enforcement, but the hammer will fall if/when an issue arises involving the transaction.

    But to that issue, as I’ve said many times, the NPA (National Private Armory) is the last bastion of true Constitutional firearms commerce that is and has always been exempt from the de facto registration that private transaction NICS absolutely would be. This is promoted and accepted even by many within our own ranks due to it being presented as innocuous to rights. Nothing could be further from the truth, and in fact is worth all-out opposition more so than bump stocks, age requirements, and almost all others…although of course all are critical and all will be used as a camel’s nose to infringe your other rights.

    Demanding and collecting private information to be used to incriminate the People violates 4th and 5th Amendment rights.

    Now the government bans stocks on pistols.. bans forend handles on pistols that are vertical. Now ‘bump stocks’ are not guns. They are just stocks you can fit to a gun. I see no reason they can’t ban ’em. Might not like that folks but what is, is.
