About that bump stock ban

There has already been a lawsuit filed against the ban:

Today, attorneys for an owner of a bump-stock device and three constitutional rights advocacy organizations filed a federal lawsuit against the Trump Administrations new confiscatory ban on firearm parts, additionally challenging Matthew Whitakers legal authority to serve as Acting Attorney General and issue rules without being nominated to the role and confirmed by the Senate or by operation of law. A copy of the court filings can be viewed at www.bumpstockcase.com.

The plaintiffs also filed a motion seeking a temporary injunction to prevent the Trump Administration from implementing and enforcing the new regulation. The lawsuit, captioned as Guedes, et al. v. BATFE, et al., is backed by Firearms Policy Coalition (FPC), Firearms Policy Foundation (FPF), and Madison Society Foundation (MSF), also institutional plaintiffs in the case.

Meanwhile, the NRA is disappointed.

And if you need instructions on how to properly destroy your bump stock, that you may have lost in a boating accident, the ATF has instructions.

While we gun nuts no that this a stupid ruling with no basis in the law, I doubt that we will win this issue due to public perception and the general ignorance about firearms most people have.

    Heath, the NRA forgot they were effing complicit in FOPA, and stupidly thought they could get bump-fire stocks classed as NFA (oops; complicit again!) items and grandfathered in.

    Even though first reported by TTAG (ugh), NRAs quiet change position in the NPRM comment that is actually in the context of your linked article is that they wanted amnesty (which was what they were disappointed about). They were trying to leverage a temporary window to open the NFA registry to machine guns in general on the premise that if you do it for these new “machine gun” bump stock owners, you need to do it for all machine guns. The official comment was submitted to the Register so it just wasn’t TTAG being TTAG. The NRA’s comment pointed out that the Treasury Department has the power for amnesty whenever they want even post 1986.

    While I don’t think bump stocks should be banned and the NRA’s intial position was wrong, in the political capital game, I would love to trade bump stocks for 60 days of sending as many Form 1s as I could afford and to see some rejuvenation of the transferable MG market. That wouldn’t probably piss off many of the hard core investment collectors but allow more of us into that market.

    As MattCFII speculates and I’ve said quite a bit, these things were/are intended as a Trojan gift. And not just for MG’s but to open other Constitutional cases before a post-RBG court, perchance to make good on those mufflers and universal permission slips that some claim were promised. I have come to believe that the Art of the Deal plays into everything DJT touches, even with the NRA itself. We’ll see.

    If you’re 07/SOT, just engrave S/N and your name and address on it and register it with NFA branch as a post sample on a Form 2.

    This is a ‘softball’, tee’d-up for failure.

    M’boy Trumpster gets to claim he cares about gun violence (while telling Nancy to shut the hell up), and we peasants (eventually) retain our 2A rights.

    “Yes”, you have to wait for the inevitable lawsuit, wait 5 years for it to crawl through lower courts, etc., but this will not stand.

    I’m not one-Eyed Jack. I don’t want the headache of the 07 right now and be on hook for the SOT fees. Nor do I want the headache of then having to figure out what to do with all my post samples if/when I decided I had enough. I rather like the whole pay my $200 tax and mostly be left alone with the paperwork.

    All of these “laws” are of course only Criminal Protection/Criminal Reinforcement measures.

    Criminals will of course have whatever they want, and the more organized, ruthless and violent the criminals, the more this is true.

    Therefor the only thing being discussed in any “gun control” conversation is whether the law-abiding may also be armed.

    Naturally, the criminal element, and those who’ve bonded emotionally to the criminal element, will want to provide as much aid and comfort to the criminals as possible, especially to the more ruthless and violent criminals. This means disarming the law-abiding, wherever and whenever possible.

    And of course, whatever the criminals decide you should do, you will do. You’ll complain about it of course, that’s all part of the process, but ultimately you’ll abide by the Criminal Protection and Criminal Enhancement laws, often proudly.

    For what other way is there for a great nation to fall? The old forces of the Dark Ages couldn’t take us down in an open, declared, frontal assault, and so this is the only way; subterfuge, Progressive rot in which every one of us will have played a role. This way, no one is innocent, we’re all playing along to some degree (hey, look at me, ya-hoo, I got my tax stamp!), so no one has any real standing at all. For what power is there in the words and deeds of the corrupted, and of hypocrites?

    MattCFII, I posted this only because I’ve been licensed for 36 years and everything is in place for me to do this. Might be fun to see what the response from ATF would be. BTW, I don’t have a bump stock. Jack.
