Stroke of the pen, law of the land
The MA assault weapons ban mirrors the federal one. And the AG of MA thinks that following the law is a loophole. Because loophole, these days, basically means “any law I don’t like”. She did so in an opinion piece at the Boston Globe. Says the mental giant:
On Wednesday, we are sending a directive to all gun manufacturers and dealers that makes clear that the sale of these copycat assault weapons is illegal in Massachusetts. With this directive, we will ensure we get the full protection intended when lawmakers enacted our assault weapons ban, not the watered-down version of those protections offered by gun manufacturers.
The directive specifically outlines two tests to determine what constitutes a copy or duplicate of a prohibited weapon. If a guns operating system is essentially the same as that of a banned weapon, or if the gun has components that are interchangeable with those of a banned weapon, its a copy or duplicate, and it is illegal. Assault weapons prohibited under our laws cannot be altered in any way to make their sale or possession legal in Massachusetts.
Well, I see her getting sued right quick. And most guns operate under essentially the same operating system these days.

So they even mention that previously banned features that “do nothing to limit the lethalness of the weapon”. So if that’s the case, why were those features banned in the first place? Did they just admit they were arbitrary bans?

Oh a lot understood it wizard.
They just figured that the “evil features” would help portray the law as a “machine gun ban”.
Note that’s the same rhetoric being used with the “weapon of war”. Though now it’s expanded to having /any/ commonality in parts, any similarity in “operating system”, and to any individual gun.
Namely the outright statement that there is no way to convert an AWB into a non AWB, including changing the action or permanently limiting capacity.

Mike, I would call it “Arbitrary and Capricious”. Tyranny is also a word that comes to mind, as well as violation of the oath of office. But this tea sure tastes good, what with all the sea salt flavor in it…. Now where’s my tar and feathers? Ahh screw it, can’t find a good mob these days for the life of me. (This is considered HYPERBOLE, Ms.”Attorney” General and that’s not just an OPINION)

Trigger pulled, hammer strikes firing pin (or striker released), primer is impacted, primer ignites powder in cartridge, bullet is propelled down barrel. All weapons now can be considered ‘assault’ weapons and therefore banned as this operating system is essentially the same as all banned weapons.
Congress shall make no law – unfortunately does not say that no one shall make no law.
MA ag has written a new law. Will the MA judiciary or the legislature allow such usurpation of their duties?
