Stroke of the pen, law of the land

The MA assault weapons ban mirrors the federal one. And the AG of MA thinks that following the law is a loophole. Because loophole, these days, basically means “any law I don’t like”. She did so in an opinion piece at the Boston Globe. Says the mental giant:

On Wednesday, we are sending a directive to all gun manufacturers and dealers that makes clear that the sale of these copycat assault weapons is illegal in Massachusetts. With this directive, we will ensure we get the full protection intended when lawmakers enacted our assault weapons ban, not the watered-down version of those protections offered by gun manufacturers.

The directive specifically outlines two tests to determine what constitutes a copy or duplicate of a prohibited weapon. If a guns operating system is essentially the same as that of a banned weapon, or if the gun has components that are interchangeable with those of a banned weapon, its a copy or duplicate, and it is illegal. Assault weapons prohibited under our laws cannot be altered in any way to make their sale or possession legal in Massachusetts.

Well, I see her getting sued right quick. And most guns operate under essentially the same operating system these days.

Governing by edict.

Team Smitty, What on God’s earth are you still doing there? Your people have already left and await your arrival. Try, at least, please, poking around middle and east TN, or central and west NC area. Just look around, come meet us, stay for dinner. Bright, friendly, educated, industrious smiths and machinists abound? maybe you’ll wonder why you ain’t left yet yourselves. I’m partial but, Other areas are nice as well.

Finally, we still have to speak of interventionism. According to a widespread opinion, there is, midway between socialism and capitalism, a third possibility of social organization: the system of private property regulated, controlled, and guided by isolated authoritarian decrees (acts of intervention).

    Mises, Ludwig von (1927). Liberalism

The Dictatorial, Anti-Democratic and Socialist Character of Interventionism

Many advocates of interventionism are bewildered when one tells them that in recommending interventionism they themselves are fostering anti-democratic and dictatorial tendencies and the establishment of totalitarian socialism. They protest that they are sincere believers and opposed to tyranny and socialism. What they aim at is only the improvement of the conditions of the poor. They say that they are driven by considerations of social justice, and favour a fairer distribution of income precisely because they are intent upon preserving capitalism and its political corollary or superstructure, viz., democratic government.

What these people fail to realize is that the various measures they suggest are not capable of bringing about the beneficial results aimed at. On the contrary they produce a state of affairs which from the point of view of their advocates is worse than the previous state which they were designed to alter. If the government, faced with this failure of its first intervention, is not prepared to undo its interference with the market and to return to a free economy, it must add to its first measure more and more regulations and restrictions. Proceeding step by step on this way it finally reaches a point in which all economic freedom of individuals has disappeared. Then socialism of the German pattern, the Zwangswirtschaft of the Nazis, emerges.

von Mises, Ludwig (1947). Planned Chaos (LvMI)

    Zwangswirtschaft means “compulsory economy”.

So they even mention that previously banned features that “do nothing to limit the lethalness of the weapon”. So if that’s the case, why were those features banned in the first place? Did they just admit they were arbitrary bans?

“…But gun manufacturers have taken it upon themselves to define what a “copy” or “duplicate” weapon is. They market “state compliant” copycat versions of their assault weapons to Massachusetts buyers. They sell guns without a flash suppressor or folding or telescoping stock, for example, small tweaks that do nothing to limit the lethalness of the weapon.”

In flagrant compliance with the law. Or in the words of Maura Healey, “exploiting a loophole.”

After 27 years, they finally understood our argument.

  10. The_Jack Says:

Oh a lot understood it wizard.

They just figured that the “evil features” would help portray the law as a “machine gun ban”.

Note that’s the same rhetoric being used with the “weapon of war”. Though now it’s expanded to having /any/ commonality in parts, any similarity in “operating system”, and to any individual gun.

Namely the outright statement that there is no way to convert an AWB into a non AWB, including changing the action or permanently limiting capacity.

Hot on the heels of Turkey’s coup d’etat, MA experiences one of its own. What do you call it when one part of government usurps the authority of the Executive, Legislative, and Judiciary branches of government, and governs by decree?

  12. ShallNOTBeInfringed Says:

Mike, I would call it “Arbitrary and Capricious”. Tyranny is also a word that comes to mind, as well as violation of the oath of office. But this tea sure tastes good, what with all the sea salt flavor in it…. Now where’s my tar and feathers? Ahh screw it, can’t find a good mob these days for the life of me. (This is considered HYPERBOLE, Ms.”Attorney” General and that’s not just an OPINION)

  13. MAS Says:

Trigger pulled, hammer strikes firing pin (or striker released), primer is impacted, primer ignites powder in cartridge, bullet is propelled down barrel. All weapons now can be considered ‘assault’ weapons and therefore banned as this operating system is essentially the same as all banned weapons.

Congress shall make no law – unfortunately does not say that no one shall make no law.

MA ag has written a new law. Will the MA judiciary or the legislature allow such usurpation of their duties?

Is Maura Healy so anal because she doesn’t get fucked in the ass enough, or is she so anal that she doesn’t get fucked in the ass ever? It’s that chicken and the egg thing again.

  15. Chas Says:

Maura Healy is so radical, that she makes rape squads seem like a sensible precaution.

Remember, I do this to entertain me, not you.
