Even more SB-15: ATF letter: AR buffer tubes on non AR pistols

Says ATF:

Use of a buffer tube on an AK-type firearm that has no use for such an item may be evidence that the weapon is intended to be fired from the shoulder. Therefore, adding a buffer tube to an AK-type pistol, where the barrel is less than 16 inches in length, would result in the manufacture of a “firearm” as defined in 5845(a)(3). However, if an AK-type pistol were to utilize an AR-type buffer tube to facilitate the attachment of a (sic) SB-15 stabilizing brace accessory, a “firearm” as defined in 5845(a)(3) would not be made and consequently lawful to possess.

This SB-15 business is getting silly.

    Congress needs to act, not punt to the Courts. Repeal the currently vulnerable parts of the GCA. When the Pres vetos the Courts will then have Congressional intent on record for political cover to overturn those portions.

    Complete repeal is probably not a realistic vote at this point but we should carve off what is: remove “sporting purposes”, move SBR/SBS/AOW and silencers to NICs; then go back for FA after the Presidency changes. Don’t let the perfect be the enemy of the good-for-now.

    Oh, fund right’s restoration and repeal Hughes to open the registry. With silencers etc to NICs, the new cheaper FA’s will have short approval wait times. Quantity in private hands “in common use” goes up and then elimination of the registry becomes politically viable.
