Civil asset forfeiture reform

Here Is How Rand Paul’s Bill Would Curtail Civil Forfeiture

  1. Jake Says:

Standard of proof. The FAIR Act requires the government to prove by “clear and convincing” evidence that property is subject to forfeiture.

    No.

    No.

    NO.

It’s not enough. Forfeiture should require proof beyond a reasonable doubt – because it should require conviction of a crime.

  2. Ken in NH Says:

I hear you Jake but it’s a start.

  3. Bram Says:

You would think this unnecessary in a country with a Fifth Amendment.

The people who will vote against this in Congress and the guy who would veto it if it did pass hate the whole Constitution and the entire Bill of Rights.

  4. Chris Says:

I don’t like forfeiture without fair compesnation, period.

I don’t care what the forfeited asset was used for.

Or where it goes after its forfeiture.

We don’t need laws which incentive law enforcement to do its job.

    I am pro-law enforcement, but I am also pro-Constitution.

Remember, I do this to entertain me, not you.
