Confiscation loophole

I’ll start taking a play from the press and call laws I don’t like loopholes.

CO passed a ban on non-FFL transfers. So, after an accident, the emergency workers secured a gun. Now, they cannot give it back due to CO law.

Sounds like the emergency workers violated the non-FFL transfer ban when they took it in the first place.

@ Standard Mischief: Actually, the City Attorney has threatened to prosecute the cops… if they dare to give the lady her gun back.

I’ll give the cops in this some credit. They secured an accident victim’s gun when she wasn’t able to, and are actively trying to find a way to get it back to her. The problem is a City Attorney who needs to be sued out of existence (along with facing his own criminal charges, IMNSHO).

Sue, sue, sue. They are knowingly and willfully violating her Second and Fifth Amendment rights. Even under color of law, this is not permissible. If possible, sue the LEOs, the city attorney and anybody else you can personally. Also, the fact pattern fits an intentional tort known as “conversion”. Lawsuits are the only things that get the attention of government officials anymore.

I agree with Ankylus.

Sue ’em! Anyone who takes a gun from another in Colorado runs afoul with the law and at the same time it is a violation of their civil rights.

Remember, I do this to entertain me, not you.
