Tex AG on banning guns in cars

Opinion here:

An employer subject to section 52.061 of the Labor Code may not ban the transport and storage of handguns in locked private vehicles by employees with concealed handgun licenses in employee parking areas by posting the notice authorized by section 30.06 of the Penal Code.

    I thought the law last year was pretty specific. The only thing I didn’t like was there was no repercussions for violating it. Still, lawsuits can be more painful than a small penalty from the state.

    Yeah, here in Texas this got fought out over the past several years, with the winning argument being that the employer is under no obligation to provide protection to the employee on the way to or from work, so the employer gets no say in what is in our vehicles.

    On the other hand, this also has slowed the employer use of unwarranted searches of vehicles for “contraband” such as alcohol and drugs, used infrequently by annoyingly as a pretext to fire people in years past. A “random” request to search your car, parked on company property, would be made. You could say yes, and worry about what would get planted in your car, or say no and be terminated instantly. A neat trick to get rid of employees in a very nasty way.
