Once again, Embody loses

For his troubles, Embody has done something rare: He has taken a position on the Second and Fourth Amendment that unites the Brady Center to Prevent Gun Violence and the Second Amendment Foundation. Both organizations think that the park ranger permissibly disarmed and detained Leonard Embody that day, notwithstanding his rights to possess the gun. So do we.

    If instead of being an upstanding citizen who just wanted to keep sitting down, Rosa Parks had been a strung out crack whore, the history of civil rights might read quite differently today.

    As for Mr. Embody, may I suggest he adopt the battle cry of, “LEEEROY JENNNNNKINS!”

    The Forest Ranger had an excellent reason to disarm Embody…. Criminal INTENT!!!!!!!!!! He was obviously planning on mass murder and the rangers stopped him before he could…

    So how do you like sounding like the Brady’s????

    Regular readers may recall that a few years ago, Unc, JayG, Breda, NJT, the Miller and I amongst many others shared Adult Beverages with Alan Gura of the SAF at the NRA Con in Pittsburgh. Now, if the man who got the Supreme Court WINS in Heller and McDonald says that this Embody Case does NOT help the Cause, then I’d take him at his word. Even Clayton G. Cramer says in the Comments that he thinks Embody may not be as Pure as one thinks in regards to the RKBA. So let’s see what happens.

    If you act like a secret squirrel, don’t get upset when you get treated like a secret squirrel. When you decide to open carry you should conduct yourself as it you are representing the entire OC community. If you are going to OC and you dress like an extra from your favorite post-apocalyptic/biker gang movie, you are intentionally segregating yourself from the societial norm to draw attention to yourself, and intentionally sending the message that gun owners are weirdos and not part of normal society. That’s your right, but you’re making a concious decision to bring attention to yourself. It’s no different than a guy putting on a dress and a fruit hat and parading around town, and then getting mad when people stare at him. If people focused more on being a member of everyday society and less about celebrating their individuality we wouldn’t have half of the problems we do now. This isn’t a gun rights issue, it’s a weirdo issue. If Embody was detained while OCing while wearing khakis and a button down this would be a different story.

    Embody was only convicted of a misdemeanor, and still has his FFL, by the way … so he can still leeroy it against the BATFE.

    So yea, he rightfully set off all the cops bad guy detectors at once. If he had simply been carrying a holstered pistol, this would not have happened.

    It would probably be cheaper to “fall off the wagon” than to continue going to the range every weekend.

    And besides, John … all the decision said was that the cop was right to detain him, determine that the weapon was legally a pistol under state law, and release him.

    This is about Embody trying to sue the cop for doing his job.

    And, if I recall what I read over at Volokh correctly, he actually did earlier carry a normal revolver in a proper holster, dressed in the same camo-clad glory, in the same park, and wasn’t stopped or interfered with.

    Coming back with the Draco pistol was him upping the ante to create drama where none had been.
