The Illinois Supreme Court held that a second amendment challenge to Cook County’s ban on assault weapons could proceed in circuit court and should not have been dismissed at the pleading stage for failure to state a cause of action. No trial has yet occurred.

There are seven justices on the Illinois Supreme Court, with a rotating Chief Justice, and only three are from Cook County. Yay!

I defended gun cases before Justice Theis when she was a circuit judge. She was also the search warrant judge for a time. She is a very good judge and a fine lady.
