Civil Rights Canceled Due To Weather

North Carolina Governor Declares Every Concealed Carry Permit in eastern NC Invalid Due to Hurricane Irene

A civil rights litigator has been working on this issue.

  1. Like I Says:

The Governor declared a state of emergency which suspends concealed carry. From what I understand, she did not explicitly single out ccw holders.

Your post title seems a little exaggerated and rather misleading to me.

  2. Chas Says:

Just when you are most likely to need it, they take it away. Yet another example of the depravity of our depraved ruling class. However, constitutional rights are not mere privileges to be incidentally dispensed with whenever a politician declares an emergency. The right to keep and bear arms exists for very important reasons. The right is made even more necessary by more difficult circumstances; certainly not less necessary.
This being America, that bizarre, mistaken and faulty point of law must be repaired and made consistent with the rights that North Carolinians have as Americans.

  3. Shootin' Buddy Says:

So, open carry or the carry of long guns is prohibited under North Carolina law?

  4. Bubblehead Les Says:

Didn’t they pass a Federal Law after Katrina that prevents Gooberners from pulling this crap?

  5. Jake Says:

@ Like I Says: The statue in question bans mere possession of a firearm while off of one’s own property, not just concealed carry.

The post title is not exaggerated or misleading. Due to the weather the right to bear arms was suspended.

@ Shootin’ Buddy: During any declared state of emergency, yes.

Perdue (wisely) crafted the order in such a way as to void the prohibitions on RKBA, and on buying beer and wine:

    http://www.governor.state.nc.us/NewsItems/ExecutiveOrderDetail.aspx?newsItemID=1983

“This order is adopted pursuant to my powers under Article 1 of Chapter 166A of the General Statutes and under Article 36A of Chapter 14 of the General Statutes. It does not trigger the limitations on weapons in G.S. § 14-288.7 or impose any limitation on the consumption, transportation, sale or purchase of alcoholic beverages.”

Having said that, those laws are utterly stupid and outrageously counterproductive, and need to be repealed ASAP.

Here is the statute re: firearms (GS 14-288.7), FWIW:

“Transporting dangerous weapon or substance during emergency; possessing off premises; exceptions.
    (a) Except as otherwise provided in this section, it is unlawful for any person to transport or possess off his own premises any dangerous weapon or substance in any area:
    (1) In which a declared state of emergency exists;”

  7. Bubblehead Les Says:

Under that Law, going for Gasoline for the Generator would be “transporting or possessing a dangerous substance in an emergency area”, now would it not?

  8. greybeard Says:

well governor screw you, I don`t need your fu&&*ing help, take care of your little pile of crap and i`ll take care of mine

  9. TIM Says:

So let me get this straight just when the people living in that state may need there weapons the most to protect against the damn looters and robbers the Governor makes it illegal. So there is a fight that breaks out at the gas pump because of shortage a guy pulls his knife and now I have nothing.Oh wait I will call 911.With budget cuts and all the evacuations do you really think Governor a cop will show up in time…

  10. Larry Says:

To be fair, it’s not the Governor that makes it illegal, it’s the statute that was enacted by the Legislature. Only the legislature can make that go away. Give us time, we’re working on it.

Remember, I do this to entertain me, not you.
