Bloomberg is playing that song again

Sends ‘investigators’ to AZ gun shows. They claim they can’t pass background checks and buy guns from dealers anyway. Except that if it happened without a background check, they broke the law. A dealer must perform a NICS check or that is a violation of law. I’m guessing they bought from individuals, who are not required to perform background checks.

Also, purchasing a handgun out of state is illegal and if NY investigators did that, they broke the law too.

Once again, loophole seems to mean doesn’t prevent a crime. Kinda like how I violated the speed limit loophole on my way in to the office.

    Wait, so If I was from NY (i am) and bought a handgun p2p in a free state, it would be illegal? where?

    Well preventing prohibited people from getting guns is just the proverbial carrot on the end of the stick. What they want is to pass ineffective laws that limit freedom.

    This is like police conducting undercover drug buys just to show off that you can buy drugs and doing nothing about the dealers.

    Of course given no arrestes or charges filed I wonder if its on par with the Joe Rosenthal and Steve Bailey “straw buy”. Nobody would sell them a gun illegally, so they had a buddy buy a gun and just pretended they broke the law.

    Didn’t the Federal Government just sue AZ to prevent that state from enforcing Federal Immigration law, claiming that enforcement of Federal Law is not within the purview of the states? If this is true, AZ should sue NY and use the case that just went against them as case law to get an injunction against NY.

    (a) It shall be unlawful –
    (3) for any person, other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector to transport into or receive in the State where he resides (or if the person is a corporation or other business entity, the State where it maintains a place of business) any firearm purchased or otherwise obtained by such person outside that State

    It seems they were trying to buy semi-auto handguns from sellers after indicating they probably could not pass a background check.

    They were successful with 2 buyers. It’s not clear how seriously they indicated they couldn’t pass a background check, though.

    Having said that, I would NOT sell to someone who didn’t have an AZ DL. Giving preference to CCW…

    So the obvious question is, “When will Bloomy be turning over his ‘sting operatives’ for federal prosecution, since they apparently broke more than a few laws?”

    Oh. Right. Laws are for little people…
