    My guess is that the AP reporter just read the Wikipedia article on the MAC-10, which calls the it a machine pistol in the first sentence.

    This was written in the piece: “people barred from owning pistols here often travel south to shop at gun shows where there are no required background checks for people buying secondhand weapons.”

    Are there states that allowed this (used handgun sales by a gun shop without a background heck)?

    Dave, Federal law prohibits gun shops from selling firearms, used or new, without the background check regardless of where the sale occurs, in the storefront or a gun show.

    I called AP national headquarters in DC at

    1-212-621-1500; it would be nice if other people called as well.

    I asked for an editor in charge, due to a detail so wrong that the error changes the entire story. They transferred me and I spoke to an editor. I asked her to immediately issue a retraction/correction because the entire story hinges on how a person could get a machine pistol.

    She said she’d look into it.

    I also asked her to look into how a major news story was released to the national wire, based on the fact that the story as told NEVER HAPPENED. She said she’d look into that too, and I said you’d better, because you need to find out how Cristian Salazar, David B. Caruso, Adam Goldman, Ula Ilnytzky and Sara Kugler in New York, Dena Potter, Colleen Long, and at least two editors failed to examine the fact that the story went to press based on a complete fabrication.

    They said Gun Show, not Gun Shop. Technically true, in that you can buy a second-hand weapon at a gun show without a background check. However, as Tam mentioned in a post a while back, it is illegal to sell a weapon across state lines without complying with the laws of both states, and implied that interstate private sale required an FFL involved even if it wouldn’t be required in either state. The private seller would be breaking the law to sell to a New Yorker at the very least since the buyer wouldn’t be legally allowed to purchase.

    Ian: They list a dealer’s name. That’s a shop, even if it happens to be a sale at a show.

    Dale’s Guns sells at gun shows in Virginia. Not sure if they have a shop, butthey are a regular on the gun show circuit.

    Of course, the gun was purchased legally, and then reported stolen. And the cops figured that out pretty quick, and let the press know, even with the Tiahart Amendment in place.

    It would be interesting to find out how many other guns that woman has purchased and reporte stolen this year. If it’s none, then there’s nothing here. If it’s a dozen, then she needs to start thinking about spending time behind bars.

    There was an episode of the First 48 (or maybe Crime 360) recently where one of the gang-banger’s girlfriends was the legal owner of an AK used in a crime by her thug boyfriend…evidently a not uncommon tactic.
