BTW, I’m firmly in the “hotlinking w/o permission is impolite, but not illegal” camp myself.

Bandwidth theft is when you directly link (i.e. hotlink or inline link) an image or file on someone else’s server so that it displays on a secondary/external website. What happens is that every time that image is viewed on an external site that is displaying the images (such as DU), the website that is hosting the file gets traffic(in this case, SayUncle). This results in the host server has to front the bandwidth needed to serve up the image. Because you have to PAY for the ammount of bandwidth your website uses, SayUncle gets to foot the bill instead of the site that is displaying the images.

I don’t think that is the correct metaphor because in this instance i was doing something which didn’t “need” permission….putting a sign up on a store requires the store owners permission- using another researchers data only requires a citation. I still hold that i didnt do anything wrong- it was for all important purposes published material and i did not see any disclaimer on the images or the site itself. I cited where i got the information and images from. I have offered to take it down if it really bothers sayuncle because it is not worth starting a fight over.

Hotlinking is stealing bandwidth, not the image itself. Even if the image is public domain (ie: the mona lisa or U.S. Constitution), they are still having you pay to host the image for them which is stealing.

Whether or not to resort to anti-theft measures like tubgirl is a personal decision. Here’s a better metaphor: If you own a store and a kid wants to hang a sign in your window for his lost dog, he should ask permission first. Even though you agree with the message, if he simply walked in and stuck his sign in your window you’d probably object.

So unless it was an image that I personally made, took, or altered, and the people linked to it without first asking me, or providing a link back to me associated with the image, I guess I would not really care. The bandwidth on my hosting account is positively absurd, so that would never break. However, if it did fall under the aforementioned category, and they did not attribute properly… oh, all bets are off baby.

technically no one is stealing your stuff since the link is posted. Stealing would be if they claimed it was their own- and they did not.

if you are angry about the pictures i will remove those too, but i won’t apologize for using them- because i did not “steal” your pictures. All pictures in DU must have their link posted if they arent your own- this as Yeppers said is considered Citing- you can cite almost any thing that has been published- and putting something on a website is considered publishing for all important purposes. By citing them i never claimed them to be mine.

There was no disclaimer that was clearly visible on your website asking people not to use your images. If it was there and CLEARLY posted then i would apologize

In short, Yeppers is correct, if you don’t want your stuff being cited, don’t post it on a webpage that is open to the public- or put a disclaimer on it.

BTW- you could have also contacted DU administration if it was causing your problems- they would have removed the link right away. What i see you were talking about here is nothing more than childish.

I tried reading that ‘gun’ forum – made my brain hurt.

You might be able to pass the image through some sort of “watermark script”.

There are dozens of other tricky things you could do besides something as obvious as tubgirl… for instance, you could replace the image with something nearly identical, but that makes them look silly. You could also replace the images they link with a huge file (if you don’t care about your own bandwidth.)

You can also do some fun stuff with php… you can configure your webserver (via htaccess if you use apache) to parse those particular image files as php, then replace the jpg content with some fun php stuff that returns random images from flickr.

The geeky possibilities are endless.
