Park Carry

The Department of Interior has proposed new rules for carrying in parks:

This move will restore the rights of law-abiding gun owners who wish to transport and carry firearms for lawful purposes on most DOI lands, and will make federal law consistent with the state law in which these lands are located. Fifty-one U.S. Senators sent a bipartisan letter to the Department of Interior (late last year) supporting the move to make state firearms laws applicable to National Park lands and refuges.

    In recent decades it seems your rights have been violated most egregiously while on government property. I’ve taken that as proof of what they’d like to do everywhere else.

    One would think that a citizen’s Constitutional rights should be protected, to the very highest degree, on federal lands. That seems to have been far from true. Maybe this is a step toward rectifying the issue. We’ll see.

    “Law-abiding citizens should not be prohibited from protecting themselves and their families while enjoying America’s National Parks and wildlife refuges,” said Chris W. Cox, NRA chief lobbyist. “Under this proposal, federal parks and wildlife refuges will MIRROR THE STATE FIREAMR LAWS FOR STATE PARKS. This is an important step in the right direction, and we applaud efforts to amend the out-of-date regulations.”

    In Tennessee, here is the rule:

    In park, natural, and historical areas the use of traps, seines, handthrown spears, nets (except landing nets), firearms (including air and gas powered pistols and rifles), blow guns, bows and arrows or crossbows, and any other implements designed to discharge missiles in the air or under the water which are capable of destroying animal life is prohibited. The possession of such objects or implements is prohibited unless they are unloaded and adequately cased, or broken down or otherwise packed in such a way as to prevent their use while in the park areas.

    Exception 1: Shooters may use recreational target shooting ranges available for skeet, trap and bow and arrow target shooting within a park area as long as these weapons are properly cased when not on the range.
    Exception 2: Authorized Federal, State, County and City law enforcement officers may carry firearms in the performance of their official duties.
    Exception 3: Persons using park area facilities while participating in authorized open or managed hunts within the park areas or beyond, may use and possess firearms under the specific rules and regulations pertaining to the authorized hunt and only in the authorized hunting zones or compartments.

    CarlS – your source is to the state park “policy.” This is NOT spelled out in the law as far as I can identify. The applicable law is TCA §39-17-1311 (http://www.michie.com/tennessee/lpext.dll?f=templates&fn=main-h.htm&cp=tncode)

    However, in wildlife management areas TCA 70-4-117 says: 70-4-117. Possession of weapons in areas inhabited by big game — Penalty. — (a) It is unlawful for any person to be in possession of any firearm, bow and arrow, shotgun or rifle in, on, or while traversing any refuge, public hunting area or wildlife management area frequented or inhabited by big game, except during specified or lawful open seasons on these areas. Any person violating this section is guilty of hunting big game and shall be punished as provided for in subsections (b) and (c).
