The Hebrew root word used in that commandment means 'murder', not kill. The use of "kill" is, I believe, a King James English artifact. The connotation of kill today was not the same as it was then. (You wouldn't say that you slew a home intruder today, but you would have then). While 400 years is pretty old, it's not even close to the 'construction' of a 3000 year old document.
