		<description>I think SM&#039;s right.  This decision is far too wacky to stand up on appeal, or even to serve as a serious  argument against Republicans between now and election day.  The most it can accomplish between now and November is to remind voters which party is serious about protecting national security and which one is actively trying to undermine it.</description>

I also don&#039;t expect this decision to last, but that&#039;s because I don&#039;t see any good legal &lt;i&gt;grounds&lt;/i&gt; for it, though since there&#039;s no details of the decision that analysis can change... (Free speech grounds to strike down a wiretapping program? That must be an... interesting argument.)</description>
