To pick on one of your pet rights, the right to buy a gun <i>must</i> be Constitutionally protected, because if it isn't, then your Constitutional right to <i>own</i> one is meaningless and unenforceable. The same holds true with the right to privacy and the fourth amendment. The 4th makes no sense at all without the underlying assumption that individual privacy is to be valued and protected. Yup, and no right to breath, have kids, buy a house, life, abortion, choice. But, you know, I’d say a few of those are still valid rights.

It could ban the purchase and sale of guns, but only if it wants to give us all guns for free.
