[...] John Cole rounds up other post-Kelo cases, including confiscation to build a Dallas Cowboy Stadium. How is that public use? He also has some good news from other states, similar to my list here. [...]

Just thought you would like to know that in Knox County, Tennessee we have passed an ordinance that would require a supermajority (2/3) of the County Commission to approve the use of eminent domain whether the intent and effect is to deprive any private person, corporation or entity of real property and transfer that property to any other private person, corporation or entity.

That may not sound like much, but the Commission recently (but before the Kelo controversy) was unable to agree to condemn a small strip of land from a cattle stockyard to serve as an access for a local county-owned refuse and recycling center. Requiring a two-thirds majority for a Kelo-style condemnation effectively removes such a condemnation from the realm of possibility, unless the need and public desire for such is absolutely overwhelming.

Knox County is the third largest county in Tennesse, with a population of around 400,000.

You seem to have missed the biggest state move since the decision: Alabama's house, senate and governor gave the finger to SCOTUS by passing legislation that specifically prohibited the new and expanded "public purposes" they created in Kelo.

I will be really impressed when a political body veto’s the entire eminent domain ruling and only recognizes the use as stated in the constitution. Many many cities, counties decided not to recognize the initial patriot act, so why not to eminent domain. To settle for anything less is giving up in my eyes, and would make a strong statement to the Supreme Court to the effect that they should not try to make laws as it is not in their job description. All of the listed appeasements are a step in the right direction, but it seems to me these are massaging the issue for votes rather than opposing them totally.

Well, you will notice that Maryland isn't up there on your list. That's because in Maryland we were into Kelo, before Kelo was "cool".
